These General Conditions of Sale exclusively govern commercial relations with our customers for the sales and services presented on the website www.elsalee.fr.
Any order implies prior consultation and acceptance of these General Conditions of Sale.
It is understood that persons considered legally incapable of contracting within the meaning of Articles 1123 et seq. of the Civil Code, in particular unemancipated minor children, must obtain the authorization of their legal representative prior to any order.
Given the seasonality of our business, our product offers are valid while stocks last.
Order
You can place an order on our website by selecting the items of your choice, which you will then place in your shopping cart by clicking on the "Add to cart" button.
You can access the summary contents of your shopping cart at any time as long as the order has not been definitively validated in order to correct any errors in data entry.
The order is only registered after confirmation of the accuracy of the information provided. This order acceptance becomes final by clicking on the "Order" button.
We will acknowledge receipt of your order as soon as possible in the form of an email summarizing your purchases which will be sent to the email address you provided when confirming your order.
When placing your order, you will also be informed of the availability of the items. Only available products can be ordered.
If, through no fault of our own, a selected item is unavailable, you will be notified as soon as possible. You will then be able to change your choice if you wish. You can also cancel your order at any time before receiving your package, regardless of the delivery time.
www.elsalee.fr and the company ELSA GROUPE SAM reserve the right not to honor an order in the event of a legitimate reason as defined by the regulations (dispute relating to a previous order, abnormal request from the customer).
Price
Prices are indicated in Euros including all taxes (TTC), excluding the flat-rate contribution to order processing costs of €6.95 for standard delivery (in Metropolitan France).
VAT included is the French VAT in effect on the day of the order.
The products remain the property of www.elsalee.fr and ELSA GROUPE SAM until full payment of the price.
In the event of a typographical error in the price of a product on the site or in the event of a technical error, ELSA LEE PARIS will notify the customers concerned of said error and may cancel the order for the product(s).
Payment
Payment is made online, at the time of ordering, by credit card via the BNP Paribas Mercanet payment module.
VISA and EUROCARD MASTERCARD bank cards (except E-cartes bleues) with accounts domiciled in Metropolitan France (including Corsica) and the French overseas departments are accepted.
Credit card transactions on www.elsalee.fr are secured by the E-Transactions payment system. All information exchanged to process the payment (16-digit card number, expiration date, visual cryptogram) is encrypted using the SSL protocol. This data cannot be detected, intercepted, or used by third parties. It is also not stored on our computer systems.
Purchases paid by credit card (VISA and MASTERCARD) can be secured by the 3D Secure control system. When you pay for your order by credit card, if your bank adheres to the "Verified by Visa" or "Secure Code Mastercard" payment security program, after clicking on "Order and pay", you may see a new screen appear, inviting you to identify yourself, for example, with a code received by SMS.
Delivery
To ensure quality service, our brand has chosen to partner with DPD France, offering you two simple and fast delivery methods.
Subject to acceptance of your order, your package will be delivered within 48 working hours after dispatch (excluding public holidays, for delivery of non-personalized items available in Metropolitan France, including Corsica, to your home from Monday to Saturday).
Delivery by Relais Pickup : €6.95 (free for purchases over €75*)

• Long opening hours for parcel collection (75% of relay points open between 9 a.m. and 7 p.m.).
• Relays open on weekends: 100% of our points are open on Saturdays and almost 50% on Sundays.

Delivery by Predict : €6.95 (free for purchases over €75*)
Set the time and date that works best for you.
• On the day the package is sent, you will be notified by SMS or email of the delivery date. At your request, you can postpone the delivery date by 1 to 3 days.
• If we do not hear from you, your package is automatically delivered the next business day.
• On the day of delivery, you will be notified by SMS or email of the delivery time slot you have selected.

Regardless of the shipping method chosen, we will provide you with a link as soon as possible that will allow you to track the delivery of your package online.
Shipping costs include packaging, handling, and postage. We recommend consolidating your purchases into a single order. We cannot combine two separate orders, and you will be responsible for shipping costs for each order. Your package is shipped at your own risk; however, we take special care with each package to make your experience on our e-store unique.
Carefully check the condition and contents of the package upon receipt. If the package is damaged, refuse the package and ask the carrier for a copy of the delivery slip confirming your refusal. If you accept the damaged package, please report it on the carrier's receipt "damaged package"; if possible, make specific and justified reservations on the delivery receipt upon receipt of your package; and open the package directly in front of the carrier to check the condition of the product. In the event of damage or missing items, please refuse the package. Elsa Lee Paris declines all responsibility for theft in the event that the damaged package has been received.
Any delay or failure to perform the services provided for herein shall not constitute a fault attributable to ELSA GROUPE SAM to the extent that it can be justified that this delay or failure to perform is attributable either to the consumer, or to the unforeseeable and insurmountable act of a third party to the contract, or to a case of force majeure as defined by the regulations, in accordance with Article L. 121-19-4 of the Consumer Code.
Right of Withdrawal
In accordance with the law, you have 14 days from the date of receipt of your package (or in the case of an order for several items delivered separately, from the date of receipt of the last item) to inform us of your decision to withdraw, whatever the reason.
For this purpose, you can use the Sales withdrawal form accompanying your invoice or any other similar unambiguous declaration.
Your item must be returned to us within 30 days from the date you informed us of your decision to withdraw.
To protect your item during transport, simply place it carefully in its case and then in a suitable cardboard packaging (do not use a paper envelope) and send it to the address indicated on the return slip, accompanied by the "return slip", the invoice and any instructions for use, with your precise instructions. As the costs and risks of transport are the responsibility of the sender, we remind you that your items can only be returned to us by registered parcel or by declared value shipment as part of the universal postal service offer, in accordance with the regulations.
Only items returned in new condition and without having undergone any transformation into a condition suitable for resale will be exchanged or refunded. Items returned incomplete (instructions for use, box, invoice), damaged or damaged will not be accepted.
A discount may be deducted from the trade-in price in the event that the item has suffered depreciation resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the item.
The refund will be made no later than 30 days from receipt of the item or proof of shipment of the item (if proof of return is communicated to us before receipt of the item) using the same payment method as that used for payment, unless otherwise agreed by the customer and at no additional cost. The refund or exchange will be made by ELSA GROUPE SAM after verification of the condition of the item.
The cost of returning the item is not refunded, except in the event that ELSA GROUPE SAM offers a replacement item for the item ordered which is unavailable or in the event of delivery of a defective item or one which does not conform to the item ordered.
For your information, items purchased online cannot be exchanged or refunded in corners and/or stores.
Elsa Lee Paris 2-year warranty
The ELSA LEE PARIS guarantee applies to jewelry and watches from the ELSA LEE PARIS brand.
It is valid for 2 years from the date of issue of the invoice, dated the day of purchase.
Your jewelry is guaranteed against all manufacturing defects for a period of 2 years from the date of purchase. This warranty applies under normal use.
The following are expressly excluded from the warranty : Defects resulting from accidents, improper or abusive handling or use (such as shocks, marks of blows, crushing, exposure to corrosive agents), as well as the consequences of skin acidity, wear and normal aging of the jewelry. Losses or breakages resulting from an accidental circumstance are not included in this warranty. Excluded from this warranty are wear and aging (battery, watch strap, crushing of hollow links).
In accordance with current legislation, chains and bracelets include an open and deliberately weak link to prevent any risk of accident in the event of snagging. Deformation and opening of this link following abnormal tension (tearing, accident, etc.) is therefore not covered by the warranty.
Any defective part due to a manufacturing defect duly noted by our after-sales service will be repaired free of charge or, if this is not possible, replaced. To benefit from your warranty, it is necessary to have the invoice distributed when purchasing your jewelry.
If you have any problems during this warranty period, please contact us at contact@elsalee.fr and then simply return your item with your specific instructions and we will examine it free of charge.
To protect your item during transport, place it carefully in its original packaging or in suitable cardboard packaging (do not use a paper envelope) addressed to: ELSA LEE E-SAV, 7 Rue Jean Élysée Dupuy, 69410 CHAMPAGNE AU MONT D'OR accompanied by its invoice and the after-sales service form.
Since the costs and risks of transport are the responsibility of the sender, we remind you that your items can only be returned to us by registered parcel or by declared value shipment as part of the universal postal service offer, in accordance with the regulations. We do not acknowledge receipt of your shipment.
Legal guarantees
Regardless of the above contractual guarantees, the seller is liable for defects in conformity of the goods sold in accordance with Articles L. 211-4 et seq. of the Consumer Code:
- You therefore have a period of two years from delivery of the goods to take action.
- You can choose between repair or replacement of the goods, subject to the cost conditions provided for in Article L. 211-9 of the Consumer Code;
- You are exempt from providing proof of the existence of the lack of conformity of the goods during the six months following delivery of the goods (this period will be extended to twenty-four months from March 18, 2016).
The seller is also liable for hidden defects in the goods sold under the conditions provided for in Articles 1641 et seq. of the Civil Code, a legal guarantee against hidden defects for which you have direct recourse against the seller.
You can choose between the cancellation of the sale or a reduction of the sale price in accordance with article 1644 of the Civil Code.

∞ Art. L. 211-4. “The seller is required to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. He is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation when this has been placed under his responsibility by the contract or has been carried out under his responsibility.”
∞ Art. L. 211-5. “To comply with the contract, the goods must:
1. Be suitable for the use usually expected of a similar good and, where applicable:
▶ correspond to the description given by the seller and possess the qualities that the latter presented to the buyer in the form of a sample or model;
▶ present the qualities that a buyer can legitimately expect in view of the public statements made by the seller, by the producer or by his representative, in particular in advertising or labeling.
2. Or Present the characteristics defined by mutual agreement by the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted.
∞ Art. L. 211-9 “In the event of a lack of conformity, the buyer chooses between repair and replacement of the goods.
However, the seller may not proceed according to the buyer's choice if this choice entails a cost that is manifestly disproportionate compared to the other method, taking into account the value of the goods or the significance of the defect. He is then required to proceed, unless impossible, according to the method not chosen by the buyer.
∞ Art. L. 211-12. “The action resulting from the lack of conformity is prescribed by two years from the delivery of the goods”.

∞ Art. 1641. “The seller is bound by the guarantee for hidden defects in the thing sold which make it unfit for the use for which it is intended, or which so diminish this use that the buyer would not have acquired it, or would have paid a lower price for it, if he had known of them.”
∞ Art. 1644 “…the buyer has the choice of returning the item and having the price refunded, or of keeping the item and having part of the price refunded.”
∞ Art. 1648 - paragraph 1
“The action resulting from latent defects must be brought by the purchaser within two years of the discovery of the defect.”
After-sales service
At ELSA LEE PARIS, qualified professionals are available to perform any service or repair. Our After-Sales Service technicians can also assist you after the ELSA LEE PARIS warranty expires. To benefit from this service, please contact us at contact@elsalee.fr.
Return your item to us with its invoice, specifying the nature of the repair. For security reasons, send your items for repair only by post. You are responsible for the cost of sending the item. To protect your item during transport, carefully place it in its original packaging (do not use a paper envelope). As the costs and risks of transport are borne by the sender, we remind you that your items can only be returned to us by registered parcel or by declared value shipment as part of the universal postal service offer, in accordance with the regulations.
A free quote will be sent to you upon receipt of your item. You will then have one month from the date of issue to return it to us with your consent. A 20% deposit may be required. The work will be carried out upon receipt of the accepted quote within the timeframe specified on the quote, and your item will be returned to your address, at our expense, if the work is not feasible or if you refuse.
In the event of a repair carried out outside of warranty, the cost of returning the item will be your responsibility.
Our interventions are guaranteed for one year (parts and labor) within the limits of normal use.
In accordance with the law, you have 14 days from the date of signing the After-Sales Service quote to withdraw. In the event of withdrawal within this period, we will reimburse you the possible 20% deposit, no later than 14 days after receiving your decision to withdraw, using the same payment method as that used for payment, unless otherwise agreed by the customer. The cost of returning the item will be our responsibility.
If, at your request, a repair is carried out before the end of the legal withdrawal period, you will have to pay the amount corresponding to the service provided until you notify us of your decision to withdraw. This amount is proportional to the total price of the service agreed in the quote.
Applicable Law & Jurisdiction
These General Terms and Conditions of Sale and the contractual relations relating thereto are governed by French law, subject to more favorable mandatory provisions in the consumer's country. Any dispute will be brought before the competent courts in accordance with the rules of common law (or private international law).
Intellectual property
The website www.elsalee.fr and all its elements are protected by applicable intellectual property rights. They are the exclusive property of ELSA GROUPE SAM or its partners. Use of this site is reserved for strictly personal use. Any use, reproduction, exploitation, or representation, in whole or in part and on any medium whatsoever, for purposes other than personal use, is prohibited and punishable by law, particularly as a counterfeit. Any hyperlink directly to this site must be expressly authorized by us in advance.
